DEP Wetlands Letter of Interpretation Requested

Notification of Request for Freshwater Wetlands Letter of Interpretation

We received this registered letter today. It was mailed before the Holmdel Township Zoning Board meeting regarding the request for a completeness waiver. It states that KIP 20 LLC, via their agents, have filed an application for a “LOI,” or Letter of Interpretation, regarding the presence or absence of sensitive wetlands on within 200 feet of the 125—127 Red Hill Road Property.

We believe there are such wetlands, as can be seen from the map attached to my prior post. In addition, we operate two potable water wells within 20 feet of the property line between 123 Red Hill Road and 125 Red Hill Road and we also operate a potable water well at 121 Red Hill Rd. Since we are at the top of Red Hill, locally, surely this water must be sourced from the properties? Furthermore, we have seen persistent standing water, sometimes called “dew ponds,” to exists on the 125 Red Hill Rd farmland property, clearly visible from our property. Further down the hill water emerges on the southern side of the property, on Crawfords Corner Rd, in a marshland with Skunk Cabbage and a spring that regularly disrupts the blacktop on Crawfords Corner Rd itself.

There is not much time to comment. We will be preparing a response via our attorneys, but if anybody knows documentation of such wetlands please tell us directly or contact the DEP at the address given.
